How long does a personal injury case take in Kansas City

If you've ever been injured in an accident, you know firsthand how quickly medical bills can pile up and the stress that brings.  It's natural to worry about how long it will take to get compensated for your losses after filing a claim against those responsible.  Things can move fast after an accident and may become overwhelming - that's why we're here.  Our team handles everything for you, so you can focus on recovering from your injuries.

The most frequent question our clients ask is 'How long does an injury claim take in Kansas City?'  There's really no quick and easy answer, yet based on our experience in Missouri and Kansas, an injury claim typically takes anywhere from a few months to a year if it's settled out of court.  If the case goes to trial, it could take two years or more.

Each personal injury case is different, and the timeline for your case depends on a variety of factors, such as the complexity of your situation and the extent of your injuries. Our experienced accidenet attorneys are here to listen in detail and handle any situation that arises.  At Kevin McManus Law, we're good at what we do, and by your side to support you every step of the way.

Basic Steps of an Injury Claim

Understanding the basic steps involved in filing an injury claim can help you understand the timeline of your case.

Our Guarantee

First and importantly, with our firm ... there's no fee unless we win, which is our guarantee.

Building Your Case

Our team of dedicated attorneys start by building a strong and thorough case, which includes the following:

  • Investigation - We gather all necessary facts and information about your accident.
  • Collect Evidence - We collect and preserve crucial evidence that strengthens your claim.
  • Estimate Damages - We also identify the specific damages you're entitled to and estimate future losses you might face because of your injuries down the road.

During Your Case

Settlement Negotiations - Our attorneys engage in settlement neogitiations with the responsible party.  If an agreement cannot be reached, the next move is to file a personal injury lawsuit.  Our team is dedicated to fighting for the compensation you deserve.

Court Filing and Procedures - These steps provide a general overview of the process of filing an injury lawsuit and the procedures involved. Taking your case to court may be necessary if an out of court settlement cannot be reached.  Note that at any point in the court proceedings, the parties involved can still opt to settle the case and bring the proceedings to a close.

  • File Petition - Your lawyer will proceed by drafting and filing a petition that outlines your claims against all possible defendants.  It’s important to know that there are deadlines, known as Statutes of Limitations, for filing your personal injury case. • Serve the Responsible Party - Afterward, a process server will deliver the defendant the Petition and Summons, which informs the defendant that the claim has been filed and gives them the right to answer the claims in the petition.
  • Discovery - Next is the discovery phase, where the parties seek information and documents relevant to the case. Each side reviews the evidence that the other party plans to present in court.
  • Mediation - In some instances, mediation will be sought to attempt to settle between the parties and resolve the dispute. Many personal injury cases are settled during this phase, sidestepping the need for a lengthy lawsuit.
  • Trial - If mediation fails to produce a resolution, the case will go to trial.  A jury trial can span multiple days or weeks. The process involves selecting a jury, presenting opening statements, hearing testimony from witnesses, and concluding with closing statements. Ultimately, the jury determines the outcome of the case and the amount of damages to be awarded.
