Pedestrian Hit While Jogging in Overland Park, Kansas

On a November morning, our client was jogging on the sidewalk eastbound along West 119th Street in Overland Park, Kansas.  Our client neared an intersection and saw a vehicle was approaching.  She looked up and saw that the vehicle had a stop sign.  As a result, she continued across the intersection and assumed that the vehicle’s driver would abide by its duty to stop.

Unfortunately, the vehicle ran the stop sign and struck our client. The impact from the vehicle caused our client’s body to be thrown 10 feet into the middle of 119th street where she landed on the asphalt.  Her husband was jogging behind her and saw the incident unfold.  He sprinted to her side, checked for vital signs and called Overland Park police.

Pedestrian Diagnosed with Concussion with Loss of Consciousness

Our client was transported by ambulance to Overland Park Regional Medical Center.  She received diagnoses that included “concussion with brief loss of consciousness” and “post-concussion syndrome”.  Our client faced a long road to recovery, due to cognitive, visual, vestibular, and psychological impairments that were persistent and, more likely than not, permanent.  She also underwent neuropsychological testing that revealed memory impairment and PTSD along with anxiety.

At Fault Driver Blamed the Pedestrian

Despite what appeared to be clear liability and damages, the at-fault driver claimed to the police that our client had somehow caused the collision.  It's unfortunately very common for pedestrians to be blamed for causing an accident.  This is why it's important to hire our pedestrian accident attorney as soon as possible after an injury collision caused by a vehicle.
